These terms are the agreement between you and Tapademy AB, Swedish company registration number 559541-3971, about your use of Rondo. Please read the section headed DRINKING, DARES AND PHYSICAL RISK even if you read nothing else.
ACCEPTING THESE TERMS
By downloading, opening or using Rondo you agree to these terms. If you do not agree to them, do not use the app, and delete it.
If you are using the app somewhere that consumer law gives you rights these terms cannot take away, those rights still apply. Nothing here is intended to reduce them, and the section headed IF PART OF THIS DOES NOT HOLD explains what happens to any clause that goes further than the law allows.
WHO MAY USE IT
Rondo is written for adults. You may use it if you are old enough to enter a binding contract where you live, and if you are not barred from doing so under any applicable law.
Some of the material is explicit and is kept behind a gate that asks you to confirm that you are 18 or over. Confirming that when it is not true is a breach of these terms. We have no way of checking it, which is precisely why it is on you.
DRINKING, DARES AND PHYSICAL RISK
This is the most important section in this document.
Rondo can be played for points, for dares or for sips, and which of the three it uses is a setting you choose in the app. Set it to points and the app never mentions alcohol again. Set it to sips and cards will suggest that somebody drinks. Set it to dares and cards will suggest that somebody does something.
Everything the app prints is a suggestion to a room of people who are free to ignore it. It is not an instruction and it is not advice. Nobody at the table has to drink. Nobody has to do a dare. Anybody can pass on any card, at any time, for any reason or none, and a group that treats a printed card as compulsory has invented that rule by itself.
The app cannot see the room. It does not know who is playing, how old they are, how much they have already had, what they are driving or riding home in, whether they are pregnant, what medication they are taking, what they are allergic to, what they can physically do, or whether the person next to them is comfortable. It has no way to find any of that out and it does not try. Every one of those judgements belongs to the people holding the phone.
You are responsible for your own drinking and for your own participation. If you hand the phone to somebody else, you are responsible for having decided that this is a reasonable thing to do. Do not play with alcohol if you are under the legal drinking age where you are, if you are driving or will be, if you are pregnant, if you take medication that alcohol affects, or if drinking is unsafe for you for any reason at all. Alcohol in quantity is dangerous and can kill. If a card suggests a quantity, treat the number as decoration.
Dares and physical challenges carry their own risks, including injury to you, to other people and to property. Consider each one before doing it, and skip anything that is unsafe, unkind or beyond what the people in the room have agreed to.
By using Rondo you accept these risks knowingly and voluntarily. To the fullest extent the law allows, Tapademy AB is not liable for anything that happens because a card was followed, whether it involves alcohol, a dare, a physical activity, an argument, an embarrassment or anything else. This does not affect the carve-out set out under LIMITATION OF LIABILITY, which applies to this section too.
ADULT CONTENT AND THE PEOPLE AROUND YOU
Parts of this app are explicit, and one shelf of it is adults only. There is a spice setting that controls how far the ordinary cards go, and a separate gate on the adult shelf. Both are honour-system answers that we cannot verify.
A card is read out loud to a room. Before you open the explicit material, look at who can see the screen and who can hear the table, and do not open it if anyone present is under 18 or has not agreed to it. What is funny among five close friends is harassment in front of a colleague, and the app has no way to tell the two rooms apart. That judgement is yours.
If a card in this app is cruel, discriminatory, or should not exist, we want to know. Write to us and we will change it.
THE LICENCE
Tapademy AB grants you a personal, non-exclusive, non-transferable, revocable licence to use Rondo on devices you own or control, for your own private and non-commercial entertainment.
You may not, and may not allow anyone else to: copy, reproduce or redistribute the app or its content; sell, rent, lease, sublicense or lend it; use it or its content in a commercial setting, including a bar, club, event or paid entertainment, without our written permission; modify, adapt, translate, decompile, disassemble or reverse engineer it, except to the extent that applicable law expressly permits despite this restriction; remove or obscure any notice of ownership; extract or scrape the card content, in whole or in part, whether by hand or by any automated means; or use the content to train a machine learning model.
CONTENT AND OWNERSHIP
The games, cards, questions, prompts, text, artwork, layout and sounds in the app belong to Tapademy AB or are used with permission, and are protected by copyright and other intellectual property rights. The Rondo name and logo are ours. Nothing in these terms transfers any of it to you.
Any third-party names, marks or titles that appear inside a question are the property of their owners and appear only as the subject of a question. Their appearance does not imply any endorsement of, affiliation with or sponsorship of this app.
ACCURACY
We write the content ourselves, in eleven languages, and we check it. We do not warrant that every question, answer, translation or fact in the app is correct, and some of it is opinion, exaggeration or a joke. Nothing in the app is advice of any kind, and nobody should rely on it for anything that matters. Tell us about a mistake and we will fix it in a later update.
ACCEPTABLE USE
Do not use the app to harass, bully, threaten, humiliate or coerce anybody. Do not use it to pressure a person into drinking, into a sexual act, or into anything else they have not freely agreed to. Do not use it in any way that breaks the law where you are. Do not interfere with the app's operation, and do not block, spoof, automate or otherwise tamper with ad requests or purchase verification, which is a breach of these terms and of the ad network's terms as well.
PURCHASES
The ad-free upgrade is a one time, non-consumable purchase. It is sold by Apple or by Google, not by us, and it is tied to the Apple ID or Google account that bought it rather than to a device. You can restore it on another device through the store.
Prices are set by us and displayed by the store in your own currency, including any tax the store adds. We may change the price of the upgrade in future. A change never affects a purchase already made.
Refunds are handled by Apple or Google under their own policies. We cannot issue, reverse or expedite one, and asking us will only cost you time. If you are an EU consumer, note that you may be asked to waive the fourteen-day withdrawal right on digital content when you buy, which is a matter between you and the store.
ADS
The free version of the app is paid for by advertising. What that means for your data is set out in the privacy policy. Ads are supplied by a third-party network and we do not choose, review or endorse the individual ads that appear. If you see an ad that is offensive or that appears fraudulent, tell us and we will report it, but the advertiser and the network are responsible for it.
YOUR SETTINGS AND YOUR PROGRESS
Everything the app remembers is stored on your device only. There is no account, no cloud copy and no backup of ours. Deleting the app, clearing its storage, resetting the phone or moving to a new one loses it, and we cannot recover it. Please take that into account before clearing anything.
AVAILABILITY AND CHANGES TO THE APP
We may add, change or remove games, decks, cards, languages or features at any time, and we may stop supporting old versions of the app or old versions of iOS and Android. We may stop offering the app altogether. We will try not to do any of this capriciously, but we do not promise that any particular game or card will still be there in a later version. If you have bought the ad-free upgrade and we withdraw the app entirely, that is a matter for the store's refund policy.
The app does not need a network to play. It does need one to show ads and to verify a purchase.
DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, and subject to the carve-out below, the app is provided as is and as available, without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, satisfactory quality, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the app will be uninterrupted, timely, secure or error free, that defects will be corrected, or that it is free of harmful components.
Some jurisdictions do not allow the exclusion of implied warranties, and where that is so, this section applies only to the extent permitted.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, and subject to the carve-out below, Tapademy AB, its directors, employees and suppliers are not liable for any indirect, incidental, special, consequential, punitive or exemplary loss, or for any loss of profit, revenue, data, goodwill or opportunity, arising out of or in connection with your use of, or inability to use, the app, however caused and on any theory of liability.
To the fullest extent permitted by law, and subject to the carve-out below, our total aggregate liability to you for all claims arising out of or in connection with the app is limited to the greater of the amount you have actually paid us for the app in the twelve months before the claim arose, or ten euros.
THE CARVE-OUT. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or intentional misconduct, under applicable product liability law, or for anything else that cannot lawfully be excluded or limited. If you are a consumer, nothing in these terms affects your mandatory rights under the consumer law of the country you live in, including your rights in respect of digital content that is not as described or not of satisfactory quality.
INDEMNITY
To the extent permitted by law, and other than where you are acting as a consumer, you agree to indemnify Tapademy AB against any claim, loss or cost arising from your breach of these terms, from your misuse of the app, or from your use of it in a way that harms another person.
TERMINATION
These terms apply for as long as you use the app. You can end them at any time by deleting it. We may end them, and withdraw your licence, if you materially breach them. Ending them does not entitle you to a refund of the ad-free upgrade, which remains a matter for the store, and the sections that by their nature should survive, including ownership, disclaimers, limitation of liability and governing law, do survive.
FOR APPS DOWNLOADED FROM THE APPLE APP STORE
The following applies to you if you obtained Rondo from Apple's App Store, and Apple requires it to be here.
These terms are between you and Tapademy AB only, and not with Apple. Tapademy AB, not Apple, is solely responsible for the app and its content.
The licence granted to you is a non-transferable licence to use the app on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
Apple has no obligation whatsoever to provide any maintenance or support services for the app.
In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app.
Tapademy AB, not Apple, is responsible for addressing any claim by you or a third party relating to the app or your possession and use of it, including product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
Tapademy AB, not Apple, is solely responsible for the investigation, defence, settlement and discharge of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights.
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a terrorist supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with any applicable third-party terms of agreement when using the app.
Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and upon your acceptance of them Apple will have the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
Questions, complaints or claims about the app should be sent to support@tapademy.com.
FOR APPS DOWNLOADED FROM GOOGLE PLAY
Your use of the app is also subject to the Google Play Terms of Service. Google is not a party to these terms and is not responsible for the app. Purchases and refunds are handled by Google under Google's own policies.
IF PART OF THIS DOES NOT HOLD
If any provision of these terms is found to be unlawful, void or unenforceable, that provision is to be read down to the minimum extent necessary to make it enforceable, and if it cannot be, it is severed. The rest of the terms remain in full force. A court declining to enforce one limitation does not affect any other.
If we do not enforce a provision on one occasion, that is not a waiver of it.
CHANGES TO THESE TERMS
We may update these terms, and the updated version travels with the app in its next release, with the date at the top changed. Continuing to use the app after an update means you accept the new version. If you do not accept it, delete the app.
GOVERNING LAW AND DISPUTES
These terms are governed by Swedish law. If you are a consumer resident in the European Union, the United Kingdom or another country whose law gives you protections that cannot be excluded by agreement, you keep the benefit of those protections and you may bring proceedings in the courts of the country where you live. Otherwise the courts of Sweden have exclusive jurisdiction.
Before going to court, please write to us. Most things can be sorted out by email.
If you are a consumer and we cannot agree, you may be able to refer the matter to a national consumer dispute body. In Sweden that is Allmänna reklamationsnämnden, at arn.se.
